The current reality faced by municipalities is the destruction or damage of municipal administrative premises and movable property (vehicles, etc.) caused by missile attacks or active hostilities. Local councils should understand how to deal with this. It was stated by Andriy Pohorilyi, Decentralisation and Local Self-Government Adviser of the U-LEAD with Europe Regional Office (RO) in Volyn Oblast, U-LEAD Programme's Municipal Property Team member, during an information session on the issue of cessation of ownership of destroyed property.
"There are currently a number of regulations governing the procedure for inspecting movable and immovable property, urgent measures to eliminate the consequences of the armed Russian aggression, registration of real estate rights as well as registration of various types of vehicles and their rejection (deregistration). However, local self-government officials must have a clear understanding of how to act in specific cases and the risks in the legal field. For this purpose, we organise special information sessions," he said.
During the event, the specialists of local self-government received explanations on the cessation of ownership of destroyed property and the algorithm for inspecting damaged property. They also discussed the procedure for cessation of ownership of immovable and movable property, as well as the main stages of writing off destroyed and damaged property.
"At first glance, the procedure for writing off immovable and movable property seems simple. You identify the object, draw up an act and write it off the institution's balance sheet. In addition, you have to remember to contact the state registrar of real estate to cancel the ownership of the property. But hold on! What is the right way to inspect an object? And who is supposed to do it? Which decisions should the council make? Does the executive committee decide on all issues? And finally, what is the procedure for deregistering a school bus and a garbage truck of a local utility company destroyed by fire? As you can see, there are so many questions to be asked. We tried to answer all of them. To analyse each procedure. To identify the state authorities involved in the processes and to form a basic list of documents proving the fact of property destruction," added Andriy Pohorilyi.
