Municipal officials have repeatedly inquired about changes in the legislation on mandatory state social insurance from the advisers of the Regional Office of U-LEAD with Europe in the Zaporizhzhia oblast. The transfer of the powers of the Social Insurance Fund for Temporary Disability to the Pension Fund of Ukraine also gave rise to a number of questions.
“Responding to the request of the local self-government, we organised an info session held by Anastasia Lozytska and Iryna Yurchenko from the Main Office of the Pension Fund of Ukraine in the Zaporizhzhia oblast,” said Tetiana Bordiuh, Head of the Regional Office of U-LEAD.
The speakers explained the provisions of the effective laws regulating the legal procedure for the employer when using the e-services of the Pension Fund. They provided step-by-step instructions on how the employer should interact with the Pension Fund and how to establish a system process regarding the procedure for recording the employee’s work history electronically. The participants also received advice on working with e-sick leave and electronic work history records.
“The employer receives a notification on the employee’s sick leave through his policyholder’s account on the e-service portal of the Pension Fund. This e-sick leave, created in the Electronic Register of Sick Leaves, is the basis for assigning assistance in connection with temporary incapacity, pregnancy and childbirth,” the speakers said.
The event also focused on settling sick leaves for part-time employees. A new version of Law of Ukraine No. 1105 “On mandatory state social insurance” dated 23 September 1999 came into effect on 1 January 2023, amending the rules for sick leave and maternity leave settlements for part-time employees.
“According to Article 22(1) of Law No. 1105, ‘assistance in connection with temporary incapacity (including care for a sick child), pregnancy and childbirth is provided to insured persons at the main place of employment or at the place of part-time employment’,” said Iryna Yurchenko.
As she added, the first 5 days of temporary disability can be paid either at the main place of employment or the place of part-time employment, since the Procedure for Calculating the Average Salary (Income, Financial Support) to Calculate Settlement under the Mandatory State Social Insurance, approved by Resolution of the Cabinet of Ministers of Ukraine No. 1266 dated 26 September 2001, remains the unchanged.
The speakers also discussed the mistakes that users make when working with the e-services of the Pension Fund. Anastasia Lozytska stressed the importance of following the instructions and requirements of the service regarding the digitisation of work history records and personnel documents (the colour of scanned copies that are uploaded, the size of files and their names, etc.).
“A two-way verification — by both the employer and the employee — is essential. The employee can access their personal account on the Pension Fund’s portal at their convenience to check the correctness of their data and update them. This approach will help avoid misunderstandings in the future,” she said.
